Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Daily AI Bites (the “service”), operated by an Australian-owned business (ABN 51 559 072 584) (“Daily AI Bites”, “we”, “us”, or “our”). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

Eligibility and age

You must be at least 16 years old to create an account and use the service. The service is not directed to children under 16. If you invite another person to a family plan, each member must create and maintain their own account, must meet this minimum age, and agrees to these Terms. As the family owner, you are responsible for the activity of members you invite and for ensuring they are eligible. By using the service you represent that you meet these requirements, that the information you provide is accurate, and that you have the legal capacity to enter into these Terms.

Your account

You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use. You may not share your account, and you may not create an account using false information or on behalf of another person without authority.

Subscriptions and billing

Subscriptions are billed in advance on a monthly or annual basis in Australian dollars (AUD) through our payment processor, Stripe. We are not currently registered for GST, so no GST is included in, or added to, our prices. If we become registered for GST in the future, GST may apply to charges made from that time and we will update our pricing accordingly. Unless cancelled, subscriptions automatically renew at the end of each billing period at the then-current price, and you authorise us to charge your payment method for each renewal. We may change subscription prices on a going-forward basis; we will give you reasonable advance notice, and changes take effect at your next renewal.

Cancellation

You may cancel at any time through the customer portal. Cancellation stops future renewals; your access continues until the end of the current paid billing period, after which it ends. We do not provide partial-period refunds for cancellations, except as set out below or required by law.

Refunds

Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial billing periods or unused access. Nothing in this section limits your rights under the Australian Consumer Law, which are described below.

Family plans and gifts

A family plan allows the family owner to share access with members they add. The family owner is responsible for their members’ compliance with these Terms and for any content their members submit. Gift subscriptions, once redeemed, are non-refundable and non-transferable except as required by law.

Acceptable use

You agree not to:

  • copy, redistribute, resell, publish, or publicly display course content;
  • use the content or service to train, fine-tune, or develop any machine-learning model;
  • scrape, crawl, or use automated means to access the service without our written permission;
  • share, resell, or sublicense your access, or circumvent access or payment controls;
  • reverse engineer, interfere with, or attempt to gain unauthorised access to the service;
  • upload unlawful, infringing, or malicious content, or misuse the AI tutor; or
  • use the service in any way that violates applicable law or these Terms.

AI tutor disclaimer

The AI tutor generates responses using third-party AI models and is provided for educational purposes only. Its output may be inaccurate, incomplete, or out of date, and does not constitute professional, financial, legal, medical, or other advice. You are responsible for independently verifying any information before relying on it. To the maximum extent permitted by law, we are not liable for any decision made or action taken based on AI-generated output.

Intellectual property

The service and all course content, software, text, graphics, and branding are owned by Daily AI Bites or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the content for your own personal, non-commercial educational use while your subscription is active. All rights not expressly granted are reserved.

Your content and feedback

You retain ownership of content you submit (such as questions to the AI tutor or feedback). You grant us a worldwide, royalty-free licence to use, store, and process that content as needed to operate and improve the service. You represent that you have the rights necessary to submit it and that it does not infringe the rights of others.

Third-party services

The service relies on third-party providers (including for authentication, payments, AI, email, and hosting). We are not responsible for the acts, omissions, availability, or content of third-party services, which are governed by their own terms.

Disclaimer of warranties

To the maximum extent permitted by law, the service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any content is accurate or complete. This section does not exclude any rights or guarantees that cannot be excluded under applicable law, including the Australian Consumer Law.

Limitation of liability

To the maximum extent permitted by law, Daily AI Bites and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the service. To the maximum extent permitted by law, our total aggregate liability arising out of or related to the service is limited to the greater of the amount you paid us in the twelve (12) months before the event giving rise to the liability, or AUD $100.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our goods or services come with guarantees that cannot be excluded under the Australian Consumer Law, and where permitted, our liability for failing to comply with such a guarantee is limited to, at our option, resupplying the service or paying the cost of having it resupplied.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Daily AI Bites and its operator from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the service, or your violation of any law or the rights of a third party.

Suspension and termination

We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to by law, or to protect the service or other users. You may stop using the service at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.

Changes to the service and these Terms

We may modify or discontinue features of the service at any time. We may also update these Terms; when we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Victoria, Australia, without regard to conflict of laws principles. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them. Before commencing any proceeding, the parties will attempt in good faith to resolve the dispute by contacting each other. Nothing in this section limits a party from seeking urgent injunctive relief.

General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any failure or delay caused by events beyond our reasonable control.
